Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to Condone the delay of 774 days in representing this Cross appeal (MD) SR.No.51911 of 2013.

(2) of CPC., praying to set aside the award dated 27.03.2007 passed in MCOP.No.7 of 2003 on the file of the Motor Accidents Claims Tribunal, Chief Judicial Magistrate, Nagercoil in so far against the fixing of contributory negligence and disallowed portion are concerned,and allow the above cross appeal.

ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.P.T.RAMESH RAJA, Advocate for the petitioner and of Mr.C.GODWIN, Advocate on behalf of the Respondents Mr.N.ASAI THAMBI, Advocate for appellant in CMA, the court made the following order:- This petition has been filed to condone the delay of 774 days in representing the cross objection.

2. Considering the reasons stated in the affidavit filed in support of this petition, this petition is allowed and the delay is condoned on payment of cost of Rs.1,000/- (Rupees One thousand only) to the Legal Services Authority attached to this bench, on or before 07.11.2016, failing which this petition shall stand dismissed automatically without any further reference to this court.
