Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to settle interest at the rate of 6% per annum for the belated payment of petitioner's terminal benefits including Provident Fund, Gratuity and Terminal Leave Salary from the date of his retirement i.e., from 28.02.2023 to 30.10.2024 and 01.11.2024, the date on which the said benefits were settled to him.

O R D E R

The present Writ Petition has been filed by a retired Special Grade Driver of the respondent Transport Corporation, who had attained superannuation on 28.02.2023, seeking a Mandamus for payment of interest for the belated disbursement of terminal benefits.

According to the learned counsel appearing for the writ petitioner, though the petitioner had retired from service on 28.02.2023, the terminal benefits were released only on 30.10.2024 and 01.11.2024. Hence, the petitioner has addressed a communication to the respondents on 08.11.2024, seeking payment of interest for the belated disbursement of terminal benefits. Since there is no response, the present writ petition has been filed.

3. Heard the learned counsel appearing for the petitioner and the learned Standing Counsel appearing for the respondents. 2/4

Considering the above said facts, the respondents herein are directed to pay the interest at the rate of 6% per annum for the belated disbursement of terminal benefits from the due date till the date of disbursement, within a period of twelve weeks from the date of receipt of a copy of this order.

5. With the above said observations, this Writ Petition stands disposed of. There shall be no order as to costs.
