The present writ petition has been filed seeking to quash the tender notification issued by the respondent Corporation on 25.11.2025 for conducting auction for 62 shops in Subramaniapuram Daily Vegetable Market.
2. According to the learned counsel appearing for the writ petitioner, members of the petitioner association have made applications for their allotment and their request has not been considered and they have gone for public auction.

The learned Standing Counsel appearing for the respondent Corporation brought to the notice of this Court that the members of the petitioner association cannot be granted any priority in view of the order of the Hon'ble Division Bench of this Court in W.P.(MD) No.3695 of 2025 dated 03.06.2025 in the case of Krishnan vs. The Principal Secretary of Corporation and others. Therefore, auction notice was issued 2/5
on 25.11.2025 and auction was conducted on 19.12.2025. Only after the auction was completed, the present writ petition was filed on 02.01.2026.

The learned Standing Counsel appearing for the respondent further submits that 46 members of the petitioner association have participated in the auction and they succeeded in the tender and they have been allotted the shops and rest of the shops have been allotted to general public, who participated in the auction.
5. Heard on both sides and perused the records.
6. The facts narrated above would clearly indicate that the petitioner seeks separate priority for its members. In fact, the members of the association have already participated in the public auction and 46 of them have succeeded. The balance shops have been allotted to third parties, who participated in the public auction. In such circumstances, this Court does not find any merits in the writ petition. 3/5
