PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of Writ of Mandamus, directing the respondents 1 and 2 to ensure peaceful work environment at workplace from unwanted discrimination, humiliation, mental harassment, which have been engaged by the respondents 3 and 4 among the members of the petitioner's union, by considering the representation of the petitioner dated 23.12.2022. This writ petition has been filed for issuance of a Writ of Mandamus, directing the respondents 1 and 2 to ensure peaceful work environment at workplace from unwanted discrimination, humiliation, mental harassment, which have been engaged by the respondents 3 and 4 among the members of the petitioner's union, by considering the representation of the petitioner dated 23.12.2022.

2. The learned counsel appearing for the petitioner would submit that the petitioner is the General Secretary of Puthiya Thamilagam Nellai

Thoothukudi District TNSTC Employees Union, Tirunelveli. The said Association was founded in the year 1998, to safeguard the welfare of the transport employees. The third respondent has insulted the labours, calling them in a singular manner without considering their age and used offending words to cause great distress. Hence, the petitioner Association made a representation to the respondents 1 and 2, on 23.12.2022. Since the said respondent has not been considered, the petitioner has filed the present writ petition.

3. Since no adverse order is going to be passed as against the respondents 3 and 4, notice to the respondents 3 and 4 is dispensed with.

4. Heard the leaned counsel for the petitioner and the learned counsel appearing for the respondents 1 and 2.

5. Considering the limited request made by the learned counsel for the petitioner, this Court directs the first respondent to consider the representation of the petitioner dated 23.12.2022 and pass appropriate

orders, after affording opportunity to the respondents 3 and 4, within a period of twelve weeks from the date of receipt of a copy of this order.

6. With the above direction, this Writ Petition is disposed of. No costs.
