PRAYER :- Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents 1 to 5 herein to provide legal assistance to the petitioner to pursue the Investigation of the death of petitioners husband namely Meharali Syed Bakkrudin in the courts of Malaysia and thereon provide compensation and other benefits to the petitioner as per Pravasi Bharatiya Bima Yojana Scheme and other eligible G.Os and Schemes, with in a stipulated time as fixed by this Court. ORDER
This writ petition has been filed for a mandamus to direct the respondents 1 to 5 herein to provide legal assistance to the petitioner to pursue the Investigation of the death of petitioner's husband namely Meharali Syed Bakkrudin in the courts of Malaysia and thereon provide compensation and other benefits to the petitioner as per Pravasi Bharatiya Bima Yojana Scheme and other eligible G.Os and Schemes, with in a stipulated time as fixed by this Court. 2/5
2. Heard the learned counsel for the petitioner, learned counsel for the respondents 1 and 2 and the learned Special Government Pleader for the respondents 3 to 5.
3. It is the case of the petitioner that her husband, viz Meharali Syed Bakkrudin, died in Malaysia on 26.05.2020, however, under mysterious circumstances. In order to provide legal assistance to the petitioner, the petitioner has sent a representation to the Chief Minister's cell on 13.07.2020, which was subsequently forwarded to the 5th respondent, who in turn forwarded a letter dated 28.08.2020 to the third respondent and the third respondent in turn had addressed a letter dated 03.11.2020 to the 1st respondent. However, since no action has been taken on the same, the petitioner is before this Court with this writ petition.
4. Considering the facts and circumstances of the case and considering the fact that the representation was preferred as early as on 13.07.2020, which has been subsequently sent to the 5th respondent, again it was forwarded to the 4th respondent by the third respondent, this 3/5
Court is inclined to issue the following direction: The first respondent is directed to consider the representation of the petitioner and pass orders on merits and in accordance with law within a period of eight weeks from the date of receipt of a copy of this order.
The writ petition is disposed of with the above direction. No costs. 01.12.2025 RR TO
