ORDER
The present writ petition has been filed seeking a mandamus forbearing the fourth respondent from putting up any construction work in Survey No. 60/15 which would prevent the access of the petitioner to the road. 2.A perusal of the records reveal that the petitioner is owning the property in Survey No.60/14, V.Ammapatti Village, Peraiyur Taluk, Madurai District. According to him, the fourth respondent made an attempt to put up a water tank in Survey No.60/15, preventing his access to the public road. 3.Pending writ petition, the construction of the water tank has been completed. However, it is the grievance of the writ petitioner that the water tank is leaking and therefore, there is a stagnation of the water in the locality. This is likely to affect his right to put up construction in his nearby property. 4.In view of the above said facts, the prayer sought for in the writ petition has become infructuous. However, the fourth respondent is directed to see that there is no leakage in the water tank and the water does not stagnate in Survey No.60/15.
