********** This Writ Petition is filed for a Writ of Mandamus directing the respondent to consider the Petitioner's representation, dated 2.12.2024 and to survey the land in S.No.80/1 in Urappanur Bit-I
Village, Thirumangalam Taluk, Madurai District with an extent of 1 acre and 34 cents and issue separate patta in his favour for an extent of 10 cents situated in the southern extreme of the western 38 cents of the total extent of 1 acre and 34 cents. 2.Mr.R.Raghavendran, learned Government Advocate(Civil Side) takes notice for the respondent. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.
3.The Petitioner earlier filed a Writ Petition in W.P(MD)No. 2241 of 2024 seeking for a direction to sub-divide the subject lands. As the Petitioner failed to make a representation before filing the Writ Petition for a mandamus, the Petitioner on advise, withdrew the Writ Petition with liberty to approach the respondent by way of a representation. The Petitioner, thereafter submitted a representation on 2.12.2024. As no action was taken on the Petitioner's representation, the Petitioner filed the above Writ Petition for the aforesaid relief.
4.The learned Government Advocate(Civil Side) appearing for the respondents, on instructions, submitted that a notice of survey was issued by the respondent on 8.1.2025 fixing the date of
survey as 22.01.2025 by the Firka Surveyor. The learned Government Advocate, therefore, submits that survey will be conducted as per the notice of the Firka Surveyor.. 5.Recording the statement of the learned Government Advocate, the respondents are directed to conduct the survey as per the directions of this Court in W.P(MD)No.243 of 2025, dated 07.01.2025 6..With the above direction, the Writ Petition stands disposed of. No costs.
