On earlier hearing, this Court observed that originally this appeal was filed in the year 2014 and thereafter, it was transferred to the concerned Sessions Court on the presumption that the Sessions Court itself can hear the appeal against the acquittal. Later, the Sessions Court had transferred this appeal to this Court by citing the judgment of the Hon'ble Full Bench, reported in 2020 3 MLJ (Crl.) 257.

4. As the matter has been transferred between the Courts on two occasions, this Court thought it fit to issue notice to the appellant in order to enable him to prosecute this appeal.

5. Despite notice was served upon the appellant, he is not present before this Court and he is no longer interested in pursuing this appeal proceedings. Hence, this Criminal Appeal is dismissed for default. 17.07.2025 Index : Yes/No NCC : Yes/No.
