ORDER
The Transfer Civil Miscellaneous Petition is filed with a prayer to withdraw the proceedings in H.M.O.P.No.183 of 2023 on the file of the SubCourt, Aruppukottai and transfer the same to the Sub-Court, Manamadurai and to pass such further order.
2.The wife is the petitioner before this Court. It is her contention that the husband has filed the above HMOP at Aruppukottai where they were having their matrimonial home. After the separation, the wife is now living in her parents house along with her two children, who are also studying only Manamadurai. Therefore, she claims grave prejudice and request transfer of the case to Manamadurai.
3.The respondent/husband inspite of notice being served on him, has not chosen to defend the petition.
4.Accordingly, the Transfer Civil Miscellaneous Petition is allowed as prayed for. No costs. Consequently, connected miscellaneous petition is closed.
