When the matter is taken up for hearing, the learned counsel for the petitioner has made the following endorsement : "On instructions, I hereby submit that final orders were passed by the Appellate Authority / first respondent herein in A.p.No.1 of 2021 pending this writ petition and further civil remedies were also taken before competent Civil Court and hence, the issue in this writ petition become infructuous. 2/4
2. In view of the endorsement made nothing further survives for adjudication. Accordingly, the Writ petition stands dismissed. No costs. The order of the dismissal would not indicate that the Court had entered into any discussion on merits and if any civil suit is pending the competent civil Court may examine the suit on the basis of the pleadings and evidence presented and not on the fact of the dismissal of this writ petition.
