Respondents Prayer: This Writ Petition is filed under Article 226 of the Constitution of India to issue a Writ of Mandamus direct the respondents to accept the findings, report and conclusion of the enquiry officer, the District Revenue Officer, at Madurai in DRO.PC.No.64/2016 dated 07.06.2017 and pass appropriate orders and discharge him from the charges levelled against him through the charge memo in ROC.No.8155/2015/F4-2, dated 07.05.2015 issued by the 3rd respondent within the time frame fixed by this Court. ORDER
This Writ Petition has been filed to direct the respondents to accept the findings, report and conclusion of the enquiry officer viz., the District Revenue Officer, at Madurai in DRO.PC.No.64/2016, dated 07.06.2017 and pass appropriate orders and discharge the petitioner from the charges levelled against him through the charge memo in ROC.No.8155/2015/F4-2, dated 07.05.2015 issued by the 3rd respondent within the time frame fixed by this Court.
2. Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondents.
3. Today, when the matter was taken up for hearing, the learned Additional Government Pleader appearing for the respondents produced a copy of the communication, dated 22.03.2019 to the effect https://hcservices.ecourts.gov.in/hcservices/
that the enquiry was ordered to be conducted on 03.04.2019 i.e., today at 11.00 a.m., He also submitted that the petitioner also appeared in the morning for enquiry.
4. At this juncture, the learned counsel appearing for the petitioner specifically submitted that earlier, enquiry was conducted, but, the same was not concluded till date.
5. In view of the above submission, this Court, without going into the merits of the case, directs the respondents to complete the enquiry and pass appropriate orders, on merits and in accordance with law, after affording an opportunity of hearing to the petitioner, within a period of four weeks from the date of receipt of a copy of this order.
6. With the above direction, this Writ Petition is disposed of. No costs.
