Respondent PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents to settle the interest at the rate of 6% per annum for the belated payment of terminal benefits of the petitioner's husband Late.M.Subramani including Provident Fund, Gratuity and Leave Salary from the date of his death i.e., 08.06.2024 to 27.11.2024 on which the said benefits were settled to her.

O R D E R

The instant writ petition has been filed by the wife of a deceased employee of the respondent Transport Corporation, seeking a mandamus directing the respondents to pay interest at the rate of 6% per annum for the belated payment of petitioner's terminal benefits.

2. According to the learned Counsel appearing for the writ petitioner, the petitioner's husband was working as Checking Inspector in the respondent transport corporation. He had attained superannuation on 31.03.2023 and he was passed away on 08.06.2024. However, the terminal benefits were disbursed belatedly only on 27.11.2024. Hence, the petitioner sent a representation on 29.11.2024, seeking interest for the belated payment. Since, there is no response from the respondents authorities, the present writ petition has been filed.

3. Considering the above said facts, the respondent Transport Corporation is directed to pay interest at the rate of 6% from the due date till the date of disbursement within a period of twelve (12) weeks from the date of receipt of a receipt of a copy of this order. 2/4

4.With the above said observations, this writ petition stands disposed of. No costs.
