ORDER

This Criminal Original Petition is filed to direct the Additional Sessions Judge(PCR), Tirunelveli to accept the surrender of the petitioners in Crime Number 230 of 2025 u/s. 296(b), 115(2), 118(1), 351(3) BNS and 4 of TNPHW of Act and 3(1)(r), 3(1)(s), 3(2)(va) of SC/ST POA Act on the file of the respondent herein and dispose the bail application to be filed by the petitioners on the same day itself.

2. Considering the nature of the relief sought for, notice to the 3rd respondent is dispensed with.

3. The case of the prosecution is that on 21.12.2025 at about 5.30 p.m., when the defacto complainant was standing on the street, two persons from the Thevar community, came on a motorcycle, hit her. When the defacto complainant and her supporters questioned the accused 2/5

persons, they have shouted the defacto complainant by using filthy language on their community and attacked them with wooden sticks and hands and threatened them with dire consequences. The defacto complainant was admitted to the Governance Medical College Hospital. On the basis of the complaint given by the defacto complainant, a case was registered against the petitioners / accused, in Crime No.230 of 2025 for the offences under Sections 296(b), 115(2), 118(1), 351(3) BNS and Section 4 of TNPHW Act and 3(1)(r), 3(1)(s), 3(2)(va) of SC/ST POA Act.

4. Heard the learned counsel on either side and carefully perused the materials available on record.

Considering the limited scope of the relief sought for, this Court hereby direct the learned Additional Sessions Judge (PCR), Tirunelveli, to issue prior notice to the de facto complainant and thereafter to consider the bail application of the petitioners on the same day of his surrender before that Court in connection with Crime No.230 of 2025 on the file of the 2nd respondent police.
