PRAYER : Petition filed under Section 528 of BNSS, 2023 to direct the 1st to 3rd Respondents to provide adequate Police Protection to the petitioner to access in to his own agricultural land in Survey No.286/2 situated in Urseri Village, Vadipatti Taluk, Madurai District, encompassing a total area of 3 acres and 89 cents, and further provide police protection to the petitioner life & limb based on the petitioner's complaint in dated 25.12.2025.

ORDER

This writ petition has been filed seeking a direction to the 1st to 3rd respondents to provide adequate police protection to the petitioner to access into his own agricultural land in Survey No.286/2 situated in Urseri Village, Vadipatti Taluk, Madurai District, admeasuring total area of 3 acres and 89 cents, and further provide police protection to the petitioner life & limb, based on the petitioner's complaint dated 25.12.2025.

2. Since no adverse order is proposed to be passed in this writ petition, notice to the private respondents is dispensed with.

The learned counsel appearing for the petitioner submitted that the private respondents herein are third parties who have no right over the petitioner's agricultural land and that they are continuously interfering with the petitioner's peaceful possession and enjoyment of the subject property without any lawful authority. Hence, he sought the indulgence of this Court.

4. The learned Government Advocate appearing for the respondent police, on instructions, submitted that upon receipt of the complaint from the petitioner, the respondent police issued CSR No. 726 of 2025. However, as the petitioner did not cooperate with the enquiry, the complaint was closed on 31.12.2025.

5. It is understood that the petitioner did not cooperate with the enquiry conducted by the respondent police and had proceeded swiftly this Court seeking police protection this Court seeking police protection. 3/6

However, considering the plight of the petitioner, the third respondent police is directed to reopen the said case in CSR No.726 of 2025 and call the petitioner and the private respondents for enquiry and deal with the matter in accordance with law. If at all the respondent police finds it necessary to give police protection, the respondent police is directed to afford such police protection to the petitioner, in terms of GO.Ms.No. 139, Home (Pol-VIII) Department, dated 04.03.2019.

6. With the above direction, this criminal original petition stands disposed of.
