The above Civil Revision Petition is filed against the order allowing the application in I.A.No.778 of 2009 in O.S.No.349 of 2005, dated 19.08.2009.

2.Today when the matter is taken up for hearing, the learned Counsel for the petitioner submitted that the suit itself is disposed of and that therefore, the present revision petition has become infructuous and submitted that the revision petition may be dismissed as infructuous.

3.In view of the submission of the learned Counsel for the petitioner, the Civil Revision Petition is dismissed as infructuous. No costs. Consequently, connected miscellaneous petition is closed.
