PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of MANDAMUS directing the 1st Respondent to take the petitioner's application dated 26.11.2025 on file and process the same by issuing notice to the Respondents 2 to 6 under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007.

ORDER
The present writ petition has been filed by a senior citizen seeking a mandamus as against the first respondent herein to initiate action based upon his application dated 26.11.2025 under the Maintenance and Welfare of Parents and senior Citizens Act, 2007.
2. A perusal of the complaint reveals that the second respondent is a tenant and the respondents 3 to 6 are the relatives of the second respondent. The petitioner being a landlord has rented out the property to the second respondent and his relatives. In such circumstances, the revenue officials cannot interfere. It is the allegation of the petitioner that they are refusing to vacate the property.

The facts narrated above clearly indicate that it is a dispute between the landlord and tenant and not an issue that is governed by the provisions of Maintenance and Welfare of Parents and Senior Citizens Act, 2007. In such circumstances, the first respondent will not have any jurisdiction to entertain 2/4
such a complaint. It is for the petitioner to approach the competent Court to evict the second respondent, if he is so advised.
4. With the above said observations, this writ petition stands disposed of. No costs.
