O R D E R

(Order of the Court was made by the Hon'ble G.K.ILANTHIRAIYAN.J.) This Civil Revision has been filed as against the order, dated 14/02/2011, passed in IA No.535 of 2008 in OA No.63 of 2007 by the Debt Recovery Tribunal, Madurai, thereby dismissing the petition filed by the petitioners seeking permission to file a counter claim petition as indigent persons on the ground that no convincing reasons are stated in the application. Further, on receipt of the notice in OA No.63 of 2007, the petitioners also filed written statement on 17/03/2008. Thereafter, the respondent had let in evidence on their side. While the matter stood posted for petitioners side evidence before the Tribunal, the petitioners filed a petition seeking permission to file a counter claim as indigent persons.

Further, the delay to claim a counter claim, that too as indigent persons was also not properly explained by the petitioners. In view of the above, the Tribunal has rejected the petition filed by the petitioners by passing the impugned order, This Court finds no infirmity in the impugned order passed by the Tribunal.

2.In the result, this Civil Revision Petition is dismissed. Since the petitioners have prolonged the entire trial in OA No.63 of 2007 for all these years by obtaining interim orders from this Court, the Tribunal is directed to dispose of the OA No.63 of 2007, on merits and in accordance with law, within a period of three months from the date of receipt of a copy of this order. No costs. Consequently connected Miscellaneous Petition is closed.
