ORDER

The writ petition is filed seeking for issuance of a Writ of Mandamus directing the respondent to dispose of the petitioner's appeal in B/11/41523/2023 within the time frame fixed by this Court 2.Mr.R.Gandhiraj, learned Special Government Pleader takes notice for the respondent. By consent, this writ petition is taken up for final disposal at the admission stage itself.

3. It is stated by the petitioner that he is having ancestral property to an extent of 0.35.0 Ares in S.No.187/2 situated at Vilangathur Group, Muthukulathur Taluk, Ramanathapuram District. When he verified the present patta, it is seen that the revenue authorities had erroneously reclassified his property as road poramboke. Hence, he preferred the appeal before the respondent/District Revenue Officer praying to rectify the error committed by the authorities at the time UDR and. Now, the said appeal is pending before the respondent. The apprehension of the petitioner is that the authorities may disturb his possession on the strength of the mutation made at the time of UDR. Hence, he filed the present writ petition. 2/5

The learned Special Government Pleader appearing for the respondent has produced a copy of the proceedings of the respondent dated 05.01.2024, wherein, it has been stated that on the appeal of the petitioner, an enquiry will be conducted on 18.01.2024 at 03.00 p.m and in this regard, notice has been sent to the parties. It is further stated that if the petitioner appears along with documents, the appropriate orders will be passed on the appeal.

In view of the above fact, without going into the merits of the matter, the respondent is directed to complete the enquiry and pass appropriate orders on the appeal of the petitioner on merits and in accordance with law, after giving notice to the interested parties, if any, within a period of eight weeks from the date of receipt of a copy of this order. The concerned revenue officials, viz., Tahsildar and Village Administrative Officer are directed to be present in the enquiry along with appropriate documents.

6.With the above directions, this writ petition stands disposed of. No costs.
