PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying this Court to transfer the investigation of Crime No. 169 of 2019 from the file of the 4th respondent to CBCID Police of Tamil Nadu to bring the truth in the matter related to the death of the son of the above said petitioner namely one Muthu Murugan. ORDER

The petition has been filed for transfer of investigation in Crime No.169 of 2019 from the file of the fourth respondent to the file of the CBCID.

2.When the matter is taken up for hearing, the learned Additional Public Prosecutor stated that while pending this petition, based on the complaint lodged by the petitioner, the fourth respondent completed the investigation and filed the final report on 06.03.2020 in Crime No.169 of 2019. Initially, the crime was registered under Section 147 of Cr.P.C and after completion of investigation, they filed a charge sheet for the offences under Sections 294(b), 323, 324, 406(1) and 306 of IPC as against four accused persons and the same is pending for committal before the learned Judicial Magistrate, Kamudhi, Ramanathapuram District. 3.Therefore, the transfer of investigation become infructuous. Accordingly, the criminal original petition is dismissed as infructuous. However, the learned Judicial Magistrate, Kamudhi, Ramanathapuram District, is directed to complete the committal proceedings within a period of two weeks from the date of receipt of a copy of the order.
