ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.D.SADIQ RAJA, Advocate for the petitioner and of M/S.M.MUTHULAKSHMI, Advocate for R1 and Mr.S.CHANDRASEKAR, Government Advocate for RR2 to R4 the Court made the following order:-
O R D E R
********** [Order of the Court was made by R.SUBBIAH, J.] This Court, by order dated 28.09.2016, granted an order of interim stay on condition that the petitioner shall deposit a sum of Rs.1,83,274/- to the credit of W.A.(MD)No.1309 of 2016, on the file https://hcservices.ecourts.gov.in/hcservices/
of this Court, in Indian Bank, Madurai Bench Branch, on or before 02.11.2016, failing which, the interim order granted would stand vacated automatically without any reference to this Court.
2. Now, the petitioner has come forward with the present petition to extend the time for complying with the said conditional order stating that due to financial constraint, he was not in a position to pay the amount. Further, the learned counsel submitted that even before the expiry of the period granted by this Court, he has filed the present application. However, we find that this Court passed the conditional order stating that if the amount is not deposited, within the time specified, the interim order of stay granted would stand vacated automatically without any reference to this Court. Now, almost, a period of one month has lapsed from the date of passing of the conditional order. Therefore, this Court is not inclined to grant extension of time. Hence, this petition is dismissed.
