DECREE:- This Second Appeal coming on for hearing on this day, upon perusing the Grounds of Appeal, the Judgments and Decrees of the Lower Appellate Court and the Court of First Instance and the material papers in the Suit and upon hearing the arguments of 1/3

Mr.A.P.MUTHUPANDIAN, Advocate for the Appellants and the Respondents 2 to 6 not appeared either in person or by an advocate, this Court while allowing this Appeal, doth order and decree as follows:-

(1) That, the Judgment and Decree of the Sub Court, Thoothukudi, dated 28.11.2008 made in Appeal Suit No.209 of 2005 be and hereby set aside and the matter is remanded to the file of trial Court ie., the District Munsif Court, Srivaikundam.

(2) that, the Appellants herein/Plaintiffs be and hereby directed to appear through counsel before the trial Court ie., the District Munsif Court, Srivaikundam on 25.04.2022 and the Appellants' Counsel gives an undertaking that the Appellants will implead all the necessary parties and make a sincere effort to include in the suit schedule all the properties belonging to the joint family and in other words, the flaw pointed out by the Court below will be set right by filing an amendment petition.

(3) that, the Court below ie., the District Munsif Court, Srivaikundam, shall of course allow the same after due notice to the parties concerned and

(4) That, there be no costs in this Appeal.
