ORDER : The Court Made the following order :- The petitioner, who was arrested by the respondent Police on 26.12.2014 for the alleged offence punishable under Section 366(A) IPC in Crime No.38 of 2014 on the file of the respondent Police, seeks bail. 2.There are totally three accused and the petitioner herein is arrayed as third accused. He was arrested and remanded to judicial custody on 26.12.2014.
3.The case of the prosecution is that the first accused had loved the victim girl who was aged about 17 years and eloped with her and in this regard, a complaint was lodged by her father. Since the petitioner happens to be the friend of A-1, he has been arrested and incarcerated. 4.The learned counsel for the petitioner would submit that except that the petitioner happens to be the friend of A-1, he has nothing to do with the alleged commission of offence. He would further submit that A-1 has also married the victim girl and both of them are living happily. 5.The learned Government Advocate (Crl.Side) would submit that petitioner is the friend of A-1 and he knows the whereabouts of A-1 and actively helped A-1 to elope with the victim girl and that is why he has been arrested.
6.This Court, taking into consideration the period of incarceration already undergone by the petitioner / third accused, is inclined to grant the relief of bail to the petitioner. Accordingly, the petitioner is directed to be released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Andipatti, and shall appear before the respondent Police daily at 11.00 a.m., for a period of four weeks and thereafter as and when required for investigation.
