PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, praying, to call for the records in Cr.M.P.No.8430 of 2023 in STC.No.45 of 2019 dated 28.12.2023 on the file of the learned Judicial Magistrate, Vadipatti and set aside the same.

This Criminal Original Petition is filed to set aside the order passed in Cr.M.P.No.8430 of 2023 in STC.No.45 of 2019 dated 28.12.2023 on the file of the learned Judicial Magistrate, Vadipatti. 1/4

2.When the case came up for hearing, the learned Counsel for the petitioner sought time for reporting settlement. Also, he sought transfer of this case to the Mediation Centre attached to this Bench for mediation. 3.On perusal of the records, it is found that the STC is of the year 2019. At this length of time, it is a wasteful exercise to refer the matter for mediation. If the intention of the petitioner is bona fide, she can settle the dispute before the learned Judicial Magistrate, Vadipatti, himself. Almost all the months throughout the year, the Mediation and Lok Adalat are conducted before the trial Court across the Country. Therefore, the petitioner can utilize the time for that.

4.In the light of the submission made by the learned Counsel for the petitioner, the learned Judicial Magistrate, Vadipatti, is advised to consider amicable settlement between the petitioner herein (accused before the trial Court) and the complainant by granting reasonable time of two months from the date of receipt of a copy of this order. If the matter is not settled, the learned Judicial Magistrate, Vadipatti may pass appropriate orders as per law.
