PRAYER: Petition under Article 226 of the Constitution of India seeking issuance of a writ of mandamus, to direct the respondents 1 to 4 to inspect the quality of the construction of the new building for Y-152, Mayiladi Milk Manufactures Co-operative Association, Mayiladi, Kanyakumari District and further direct them to take appropriate action against the 7th respondent by considering the petitioner's representation dated 07.12.2020. ORDER
[Order of the Court was made by M.M.SUNDRESH, J.] This pro bono litigation has been filed by the petitioner, inter-alia, alleging that the ongoing construction made by the respondent No.3 is not of the requisite quality, being a substandard one.
2. We cannot go into the said issue, being in the realm of factual adjudication. Furthermore, the respondent No.1 is not a competent authority. However, taking into consideration the representation made by the petitioner with respect to the quality of the building, we will only call upon the respondent No.2 to look into the representation dated 07.12.2020 and take appropriate action in the manner known to law, within a period of six weeks from the date of receipt of a copy of this order.
3. The writ petition stands disposed of with the above direction. No costs. Consequently connected Miscellaneous Petition is closed.
