J U D G M E N T

Today (02.08.2019), when the matter was taken up for hearing, there is no representation on the side of the appellant and also steps not taken for the deceased sole appellant. 2.Earlier on 10.06.2019 and 18.06.2019, appellant side counsel not ready for arguments and on 03.07.2019, the appellant side counsel stated that the sole appellant was dead and hence, the matter was listed under the caption "for taking steps for the deceased sole appellant" on 03.07.2019 and 12.07.2019. 3.On 15.07.2019 and 29.07.2019, there was no representation on the side of the appellant. This Second Appeal is pending from the year 2009, the sole appellant is dead till date no steps were taken and there is no representation on the side of the appellant, there is no use in keeping the matter pending any further. In the above circumstances, this Second Appeal is dismissed for non prosecution. No costs.
