RESPONDENTS/RESPONDENTS (MINOR RESPONDENTS ARE REPRESENTED THROUGH THEIR MOTHER AND NEXT GUARDIAN 1st RESPONDENT HEREIN) Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to Condone the delay of 201 days in filing the Civil Miscellaneous Appeal against the Award and decree made in MCOP.NO.1077 of 2015 dated 05.05.2017 on the file of the Motor Accident Claims Tribunal/Special Sub Court, Tirunelveli and thus render justice. ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.P.
PRABHAKARAN, Advocate for the petitioner the court made the following order:- In this petition, though notice was served to the respondents, they have not chosen to appear either in person or through counsel. On the other hand, the first respondent's name is printed in the https://hcservices.ecourts.gov.in/hcservices/ cause list, who is representing the minor respondents 2 and 3 as well.
Considering the fact that there is a delay of 201 days in filing the appeal and considering the reasons stated in the accompanying affidavit, this petition is allowed subject to the condition that the petitioner pays a sum of Rs.500/- towards costs to the Mediation Centre of this Court during the course of time and if such payment in made, office to post the appeal for admission on 28.04.2018, if it is otherwise in order.
