JUDGMENT

When the Second Appeal came up for hearing on 08.07.2020, 03.11.2020 and 29.02.2021, none appeared on either side. Thereafter, on 10.02.2022, the second appeal was dismissed for non-prosecution, since none appeared. Thereafter, the appellant filed a petition for restoration and the same was allowed on 01.08.2023 and directed the Registry to list the matter on 11.08.2023. Accordingly, the matter was listed on 16.08.2023 and on that day, none appeared for the appellant. Hence, this Court directed to list the matter under the caption 'for dismissal' on 28.08.2023.
