ORDER : The Court Made the following order :- The petitioner, who was arrested by the respondent Police on 29.12.2014 for the alleged offences under Sections 8(c) r/w 20(b)(ii)(B) of NDPS Act, in Crime No.162 of 2014 on the file of the respondent Police, seeks bail.
2.The petitioner is the sole accused and was arrested on 29.12.2014 for the alleged commission of offences under Sections 8(c) r/w 20(b)(ii) (B) of NDPS Act, in Crime No.162 of 2014 on the file of the respondent Police.
3.The case of the prosecution is that the respondent Police Party conducted a raid at Ottanchathiram to Dindigul Road and near Moolachathiram Bus Stop, they intercepted the accused who was found in possession of 5 Kgs of ganja.
4.The learned counsel for the petitioner would submit that for statistical purpose, the petitioner is falsely implicated and he has nothing to do with the alleged commission of offence. He further submitted that considering the period of incarceration, the petitioner may be enlarged on bail.
5.The learned Government Advocate (Crl.Side), submitted that the petitioner is having antecedent and he is involved in a similar case. 6.This Court, on consideration of the period of incarceration https://hcservices.ecourts.gov.in/hcservices/ undergone by the petitioner, is inclined to grant the relief of bail to the petitioner. Accordingly, the petitioner is directed to be released on
bail on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties each for a like sum to the satisfaction of the learned Additional District Judge of Principal Special Court for E.C and NDPS Act cases, Madurai, and shall appear before the respondent Police daily at 11.00 a.m., for a period of two weeks and thereafter as and when required for interrogation.
