Though notice has been served on the respondents by way of paper publication, none appears for them.

3.Considering the reasons assigned in the affidavit filed in support of this petition, the delay of 345 days in filing the above appeal, is condoned, on condition that the petitioner pays a sum of Rs.1,000/- (Rupees One Thousand only) to the credit of Savings Bank Account No.6514082295, Indian Bank, High Court Branch, Madurai Bench of Madras High Court Premises, Madurai-625 023, operated by the Registrar(Administration), Madurai Bench of Madras High Court, Madurai-625 023, for the purpose of removal of Seemai Karuvelam Trees, within a period of two weeks from today, failing which, this Civil Miscellaneous petition shall stand dismissed automatically without any further reference to this Court.
