Pleased to set aside the order dated 08.11.2016 made in Arbitration Original Petition No.1 of 2014 passed by the Principal District Judge, Madurai and thus render justice. ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mrs.S.SRIMATHY, Advocate for the petitioner and of MR.VEERA KATHIRAVAN for M/S.VEERA ASSOCIATES , Advocate on behalf of the Respondents the court made the following order:- (Order of the Court was made by K.RAVICHANDRABAABU,J.) This Civil Miscellaneous petition is filed to extent the time to comply the order passed on 31.01.2019 in C.M.P.(MD)No.711 of 2019 in C.M.A.(MD)No.76 of 2019.

2.While entertaining the Civil Miscellaneous Appeal, this Court, on 31.01.2019 granted interim stay on a condition that the petitioner / appellant shall deposit 50% of the amount together with interest as per the award passed in A.R.O.P.No.1 of 2014 on the file of the Principal District Judge, Madurai to the credit of C.M.A.(MD) No.76 of 2019 within a period of four weeks.
3. It is stated that due to the election process, the above said order could not be complied with within the time stipulated and however, the amount ordered by this Court was deposited on 09.05.2019 and the respondent / Contractor has also withdrawn the said amount as ordered by this Court on 31.01.2019. 4.Though it is stated that such deposit was made beyond the time stipulated by this Court due to the general election process, we inclined to condone the delay in depositing the amount beyond the time granted by this Court, more particularly, since the respondent / Contractor has also withdrawn the said amount without any protest.
