For Respondent : Mr.S.Manikandan, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. W.B.F.No. 3914 3rd MMCS/50887 of 2021 on the file of the Metropolitan Magistrate 3rd Court, Calcutta.

ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondents police for alleged offences punishable under Section 25 of the payment & Settlement Act, in Crime No. W.B.F.No. 3914 3rd MMCS/50887 of 2021 on the file of the Metropolitan Magistrate 3rd Court, Calcutta, seeks anticipatory bail.

2. The learned counsel for the petitioners submitted that the warrant of arrest has been issued on 09.12.2021. He would further submit that the said absence is neither willful nor wanton and he undertakes that the petitioners shall appear before the Court below regularly on all future hearing dates without fail. He would further submit that before issuing warrant, the summons was not issued against the petitioner.

3. The learned Government Advocate(Crl.side) would submit that the non bailable warrant has been issued against the petitioners on 09.12.2021 and the same is pending.

4. Considering the facts and the circumstance of his case, the petitioners are directed to approach the concerned Court to recall NBW already issued against them.
