ORDER : The Court made the following order :- The petitioner/Accused No.1, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 379 of I.P.C r/w 1/3

21(1) of Mines and Minerals (Development & Regulations) Act, 1957, in Crime No.256 of 2023 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that the petitioner said to have illegally transported 1⁄2 unit of river sand. Hence, the case.

3. The earlier applications filed by the petitioner were dismissed by this Court on the ground that the petitioner is having bad antecedents and involved in 6 previous case.

4. Earlier petition has been filed without any change of circumstances, except stating that out of the 6 previous cases, 3 cases have been disposed of and all the cases has been foisted upon the petitioner due to political motive. That came to be dismissed by this Court. This is the second anticipatory bail application.

5. Today, it is represented that the petitioner is ready to pay the compensation amount. But that cannot be taken into account and considered by this Court since there is no change of circumstances. Considering the previous antecedents of the petitioner, this Court is of the view that the petitioner is not entitled to any relief. This petition deserves to be dismissed.
