JUDGMENT

This Second Appeal was filed through a counsel by name Shri.V.Ayyathurai. There was no representation on the earlier occasion. I tried my best to reach out to the counsel, but in vain. The appeal is against concurrent findings. The plaintiff was aged 76 years when he filed the suit. The suit was filed in the year 2003. Therefore, there is no point in keeping this appeal pending. Thus, the Second Appeal stands dismissed for non-prosecution. No costs.
