Mr.K.Murugesan C O M M O N O R D E R (Common Order of the Court was made by the Hon'ble J.Nisha Banu J.) Today, when the matters are taken up for hearing, the learned counsel appearing for the appellant in W.A.(MD) No.2692 of 2024 filed a memo to exonerate the respondents 5 and 6, namely Dhanam and Gandhi in the writ appeal and also made an endorsement to withdraw the civil miscellaneous petitions. The contents of the said memo is extracted hereunder:
MEMO "It is submitted that in W.P.(MD).No.19872 of 2015 vide common Judgment dated 07.11.2024, it is ordered that the Respondents 5 and 6 are entitled to assignment of land and the same has to be decided by the 3rd Respondent/Revenue Divisional Officer to the lands which are available and exercised to be completed within a period of six months. As far 3/6
as the claim of W.P. (MD).No.19872 of 2015 and W.P. (MD). No.19879 of 2015 are concerned, the Hon'ble Judge has upheld the order of the 3rd Respondent that the property bearing Survey No.312/3 measuring about 1.69 Acres is surplus lands under the Tamil Nadu Land Reforms (Ceiling on Land) Act, 1961 and dismissed the writ petitions in the common Judgment dated 07.11.2024.
It is submitted that the said P.Jeya preferred Writ Appeal in W.A.(MD) No.2692 of 2024 before the Hon'ble Madurai Bench of Madras High Court and the Hon'ble Division Bench ordered for notice, private notice on 07.01.2025. In the said circumstances that the already a relief has been granted in the writ petition in W.P. (MD).No.22149 and 22150 of 2018 to the Petitioners and hence they are not necessary parties in the said Writ Appeal.
From the above said circumstances, the appellant filed this Memo to exonerate the Respondents 5 and 6 in W.A.(MD). No.2692 of 2024. Hence, this Memo is filed to that effect."
2. Recording the memo filed on behalf of the petitioners, these civil 4/6
miscellaneous petitions are dismissed as withdrawn. Post the main writ appeal for final hearing on 25.04.2025.
