Decree: This Second Appeal coming on for hearing on this day, upon perusing the Grounds of Appeal and the Judgment and Decree of the Lower Appellate Court and the Court of and the Court of Instance and upon hearing the arguments of Mr.S.Ramesh, for Mr.V.Raghavachari, Advocate for the Appellant and Respondent not appeared either in person or by Advocate, this Court while allowing the Second Appeal doth order and Decree as follows:- i)That the Judgment and Decree dated 29.07.2009 made in A.S.No.237 of 2007 on the file of the Principal District Judge, Tiruchirappalli, be and hereby is set aside and the judgment and the Decree dated 08.02.2007 made in O.S.No.1344 of 2000 on the file of the III Additional District Munsif, Tiruchirappalli, is restored, and the Second Appeal is allowed; and ii)That there be no costs in this Second Appeal.
