Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus, calling for the records relating to the impugned order dated 22.12.2023 passed by the 3rd respondent and quash the same and consequently directing the respondent to grant permission and to provide police protection to conduct the 'Kabaddi Competition' Day night match on 14.01.2024 at Sunday morning from 07.00 am to 16.01.2024 Tuesday early morning 05.00 am, and Village Sport Competition on 16.01.2024 Tuesday Morning from 07.00 am, to 17.01.2024 Wednesday Night 10.00 pm in Immanuvel sekaran ground and Vadakasiamman Kovil Anna Marumalarchi playground at Duraisamypuram Village, Sivagiri Taluk, Tenkasi District. ORDER
This Writ Petition is filed to direct the Respondents 1 to 5 to grant permission and to provide Police protection to conduct the 'Kabaddi Competition' 2/6
from 14.01.2024 to 16.01.2024 and Village Sport Competition from 16.01.2024 to 17.01.2024 in Immanuvel Sekaran Ground and Vadakasiamman Kovil Anna Marumalarchi playground at Duraisamypuram Village, Sivagiri Taluk, Tenkasi District.
2.When the case came up for hearing, the learned Additional Public Prosecutor, on instructions, submits that the rival party filed W.P.(MD) No.119 of 2024, which was dismissed by this Court earlier. Further, the learned Additional Public Prosecutor submitted that the order passed in that Writ Petition covers the subject matter of the present Writ Petition. It is the submission of the learned Additional Public Prosecutor that the earlier order stands hold good regarding this Writ Petition. If both the parties agree, the Peace Committee Meeting will hold good. The subject matter may be referred to the Executive Magistrate, since there are rival claimants and rival Organizations between the two groups belonging to the same community.
3.Therefore, the Revenue Divisional Officer, Sankarankovil and the Tahsildar, Sivagiri are suo motu impleaded as Respondents 4 and 5 and the rival 3/6
claimant headed by Paramasivam, S/o.Ganesan is suo motu impleaded by this Court as 6th Respondent.
4.In the light of the submission made by the learned Additional Public Prosecutor, the Respondents 4 and 5 after convening the Peace Committee Meeting shall pass appropriate orders as expeditiously as possible. They can insist regarding time, place and conditions. The Petitioner and the sixth Respondent are directed to appear before the Executive Magistrate/the Revenue Divisional Officer, Sankarankovil, and cooperate with the Peace Committee Meeting. With the above directions, this Writ Petition is disposed of. No costs.
