RESPONDENTS/RESPONDENTS Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to condone the delay of 945 days in representing the appeal in CMA (MD)SR No.24573 of 2016 filed against the order and decree DT 10-32016 in MCOP NO.1172 of 2014 on the file of the Additional District and Session Judge/Essential Commodities Special Court of Tanjore. ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MR.V.SAKTHIVEL, Advocate for the petitioner, and of MR.N.
SUDHAGAR NAGARAJ, Caveator for R1, the court made the following order:- This Civil Miscellaneous Petition has been filed to condone the delay of 945 days in re-presenting the said appeal. 2.Being satisfied with the reasons stated in the affidavit filed in support of this petition, this petition is allowed on condition that the petitioner/Insurance Company deposits the entire award amount to the credit of M.C.O.P.No.1172 of 2014 on the file of the Additional District and Sessions Judge/Essential Commodities Special Court of Tanjore, and deposits a sum of Rs.1,000/- to the credit of Legal Aids Service Authority attached to this bench within a period of three weeks from the date of receipt of a copy of this order, failing which, the delay condoned by this Court shall stand vacated automatically without any further reference to this Court.
On such deposit being made, the claimants are permitted to withdraw 50% of the deposited amount on their proportionate shares with https://hcservices.ecourts.gov.
accrued interest and costs without filing any formal petition before the Tribunal.
