ORDER
This Criminal Original Petition has been filed seeking a direction to the learned Sessions Judge, Special Court for Exclusive trial of SC/ST (POA) Act Cases, Pudukkottai, to accept the surrender of the petitioner and consider his bail application on the same day on merits in relating to Crime No.134 of 2025 dated 31.12.2025 on the file of the second respondent police.
2. Considering the nature of the relief sought for, notice to the 3rd respondent is dispensed with.
3. The case of the prosecution is that when the defacto complainant went to Iruvakaruppar Kovil along with his family, the 2/5
petitioner also came there. The defacto complainant enquired about his health, however, the petitioner, without responding to the same, removed the old flowers from the idol and replaced it with new flower. When the defacto complainant questioned the same, the petitioner abused him in filthy language using caste name and threatened to kill him. Based on these allegations, an FIR has been registered against the petitioner.
4. Heard the learned counsel on either side and carefully perused the materials available on record.

Considering the limited scope of the relief sought for, this Court hereby direct the learned Sessions Judge, Special Court for Exclusive trial of SC/ST (POA) Act Cases, Pudukkottai, to issue prior notice to the de facto complainant and thereafter, to consider the bail application of the petitioner on the same day of his surrender before that Court in connection with Crime No.134 of 2025 on the file of the 2nd respondent police.
