ORDER : The Court Made the following order :- The petitioner, who is arrayed as the sole accused in Crime No.251 of 2014 on the file of the respondent police, was arrested and remanded to judicial custody on 23.10.2014 for the alleged offences punishable under Sections 294(b), 324, 307 of I.P.C., @ 294(b) and 302 of I.P.C., and hence, seeks bail.

2.The case of the prosecution is that due to previous enmity, the accused attacked the deceased on 23.10.2014 and caused his death. 3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case and moreover, the respondent has completed the investigation and also filed a charge sheet, which was taken on file as P.R.C.No.1 of 2015 and the case has been committed to the Sessions Court and the same is pending before the Additional Sessions Court, Virudhunagar District, Virudhunagar in S.C.No.57 of 2015.

4.Per contra, the learned Government Advocate (Crl.side) vehemently opposed the bail application stating that the petitioner does not have permanent residence in Tamilnadu and he belongs to the state of Assam and once the petitioner is granted bail, he will not be available for https://hcservices.ecourts.gov.in/hcservices/ trial.

5.Considering the submission made by the learned Government Advocate (Crl.side), this Court is not inclined to grant bail to the petitioner. Hence, this criminal original petition is dismissed. However, the Additional Sessions Court, Virudhunagar District, Virudhunagar shall dispose of the case S.C.No.57 of 2015 within a period of two months from the date of receipt of a copy of this order.
