PRAYER: This Criminal Original Petition has been filed under Section 482 of Criminal Procedure Code, to call for the records relating to C.C.No.177 of 2013 pending on the file of the Judicial Magistrate No.II, Kovilpatti and quash the same.

O R D E R

This quash petition is filed to call for the records relating to C.C.No.177 of 2013 pending on the file of the Judicial Magistrate No.II, Kovilpattti and quash the same.

2.Heard the learned counsel appearing for the petitioners and the learned Additional Public Prosecutor appearing for the first respondent.

3.On perusal of grounds would show that all the grounds raised by the petitioners can be considered only during the time of trial. The grounds raised in the petition have to be gone into in a full fledged trial. Therefore, this criminal original petition is liable to be dismissed.

4.Since the case is of the year 2013, the learned Judicial Magistrate No.II, Kovilpatti, Tuticorin is directed to complete the entire trial proceedings within a period of three months from the date of receipt of a copy of this order.

5.With this direction, this criminal original petition is disposed of. Consequently, connected miscellaneous petitions are closed. However, the petitioners are at liberty to raise all the grounds before the trial Court.
