PRAYER: The Civil Revision Petition has been filed under Article 227 of Constitution of India, to allow the civil revision petition by setting aside the fair and decreetal order passed in I.A.No.77 of 2012 in O.S.No.215 of 2010 dated 09.03.2012 on the file of II Additional Subordinate Court, Tirunelveli.

O R D E R

The present revision petition has been filed by the defendants 1 to 3 in O.S.No.215 of 2010 on the file of the II Additional Subordinate Court, Tirunelveli. The respondents 1 and 2 herein as plaintiffs have filed the suit for relief of mandatory injunction directing the first defendant Diocese to conduct fresh election to the Church Council and Diocesan Council after appointing a retired District Judge as observer. The said suit was filed in December 2007.

2.According to the learned counsel for the first respondent/plaintiff in the suit, the suit itself has been dismissed for default on 07.06.2017. 2/4

Hence, nothing survives in the present revision petition. Accordingly, this Civil Revision Petition is closed. No costs. Consequently, connected miscellaneous petition is also closed.
