PETITION FOR BAIL Under Sec. 439 Cr.P.C.

ORDER : The Court Made the following order :- The petitioner in Crl.O.P.No.10095 of 2015, who surrendered before the Judicial Magistrate NO.V, Trichy, on 28.05.2015 and remanded to judicial custody on the same day for the alleged offence under Sections 147, 148, 324, 307 and 302 IPC in Crime No.89 of 2015 and for the alleged offence under Sections 147, 148, 294(b) and 506(ii) IPC in Crime No.93 of 2015 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that due to previous motive, the accused attacked one Rajkamal and four other persons on 17.02.2015 and in which one Namasivayam died.

3. The learned counsel for the petitioner submitted A1, A3 and A5 in this case were already arrested and released on bail and even as per prosecution case, the petitioner attacked with stick, which has not caused fatal injury.

4.The learned Government Advocate (Crl.side) submitted that the petitioner had attacked the deceased and other witnesses with stick and major part of investigation is over.

5. Considering the overt act attributed against the petitioner and the stage of investigation, I am inclined to enlarge the petitioner on bail on the following conditions. Accordingly, the petitioner is directed to be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.V, Trichirappalli, and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m until further orders.
