CORAM
THE HONOURABLE MR.JUSTICE C.V.KARTHIKEYAN and W.M.P(MD)No.243 of 2022 P.Jeyabalan ... Petitioner Vs.

Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, by directing the Respondents No.1 to 3 to monitor the Pongal Festival at Mallakottai Village, Sivagangai District to be conducted without any special honour (Thozhu Mariyathai) to the Respondent No.5, from 14.01.2022 to 16.01.2022 or any other date.
For Petitioner : Mr.S.Louis For R-1 to R-4 : Mr.J.John Rajadurai, Government Advocate.
ORDER
Heard Mr.S.Louis, learned counsel for the petitioner and Mr.J.John Rajadurai, learned Government Advocate who takes notice for respondents 1 to 4.
2. The petitioner has filed the Writ Petition in the last minute probably and deliberately and claims that during every Pongal 1/3
Festival, there has been some altercations and disturbances primarily between the group of the petitioner and the group of the fifth respondent. In view of the fact that the Pongal Festival have to be conducted within a period of three (3) working days, it would only be an exercise and futility to issue notice to the fifth respondent herein.
3. However Mr.J.John Rajadurai, stated that the fourth respondent had given written instructions that the Tahsildar who is the third respondent of Singampuneri Taluk, Sivagangai District had convened a Peace Committee Meeting, for this very purpose to conduct the Pongal Festival peacefully and in harmony. Primarily, a duty lies on the petitioner, instead of rushing to Court to ensure that peace is maintained. It is not necessary that he should participate in every function for peace to be maintained. Sometimes, if he withdraws from participation also, peace would be maintained. Even then whatever respects are to be given in the Pongal Festival would be afforded to him.
4. I cannot give any further direction except to direct the third respondent/the Tahsildar, Singampunari Taluk to conduct a Peace Committee Meeting and a direction is given to the petitioner and to every other individual in the said Village to participate in the Peace Committee Meeting, give necessary undertakings and abide with undertakings.
5. With the said observations, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition stands closed.
