PRAYER :- For bail in Crime No.486 of 2019 on the file of the Respondent police.

ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Crl. Side) appearing for the respondent.

2. The petitioner is in custody since 12.11.2019, for the offences under Section 366(A) of I.P.C., Section 9 of Prohibition of Child Marriage Act, 2006 and Section 5(L) r/w. Section 6 of Protection of Children Sexual Offences Act, in Crime No.486 of 2019, on the file of the respondent police. Hence he seeks bail.

3. The petitioner's earlier bail petition was dismissed by me on 17.12.2019. I had stated as follows:- https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD). No.327 of 2020 "3. The petitioner is a married person. He is not living with his wife. He developed intimacy with another married woman. The victim happens to be the classmate of the daughter of the said woman. The petitioner by sending messages to the victim girl made her leave her home and lived with her as husband and wife for more than a month. The petitioner's conduct is beyond condonation.

4. I went through the statement recorded under Section 164 of Cr.P.C. The victim girl has graphically described as to how the petitioner had induced her to leave her home and join him. The petitioner is aged 36 years. The victim is aged 17 years. The petitioner has spoiled the life of a young girl."

4. The learned Government Advocate (Crl. Side) states that final report has been filed. It is said to be in full shape. Therefore, the Jurisdictional Court is directed to take the same on file without any delay. The cognizance of the offences shall be taken immediately. The victim shall also be examined within a period of one month from the date of taking of the cognizance as per the statutory mandate. This criminal original petition is dismissed with liberty to the petitioner to renew his bail petition after the examination of the victim.
