The learned counsel for the appellants made a statement that the first appellant has passed away and despite request, none came forward to implead themselves in the place of the first appellant. So far as the other two appellants are concerned, despite issuing necessary communication to them, they did not turn up. The learned counsel now files necessary memo to that effect.
