PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of mandamus, directing the 1st respondent to take appropriate proceedings as against 2nd and 3rd respondent for their illegal service connection No. 612 situated at survey No.97/2 of Vempathur Village, Sivagangai Taluk and for the restoration of proceedings in tha.mi.va.pa.oo.va.oo/Ko.kattu/A/147/09 05.08.2009 within a time frame as may be fixed by this Court. ORDER
The present writ petition has been filed directing the first respondent to initiate appropriate proceedings as against the respondents 2 and 3 for their illegal service connection No.612 situated at S.No.97/2, Vempathur Village, Sivagangai Taluk.
2. It is brought to the notice of the Court that a Civil dispute is pending between the parties in S.A.No.525 of 2016. In such circumstances, the service connection granted in favour of the 2nd and 3rd respondents cannot be considered to be illegal. The petitioner is at liberty to approach the first respondent for initiating action as against the second respondent depending upon the outcome of the said Second Appeal.
3. With the above said observations, this writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is also closed. 04.02.2026 NCC : Yes/No Index : Yes/No Internet: Yes/No RJR 2/4
