ORDER : The Court Made the following order :- The petitioners/A13 and A20, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 147, 148, 294(b), 323, 324, 342, 506(ii), 302 and 212 of IPC in Crime No.261 of 2023, on the file of the respondent police, seek anticipatory bail.
2.The case of the prosecution is that there is an oral dispute between the petitioners' side and the de-facto complainant's side with regard to the Jeyamangalam, Mariamman Temple. When the petitioners went to the said temple on 11.10.2023, the oral dispute became a biggest dispute. Then A1 and A2 attacked one Irulappan with deadly weapons along with A5 and A8 and few others and the said Irulappan died. Hence the case.
3.Heard the learned counsel on either side and perused the material records of the case.
4.It appears that this is the second application for anticipatory bail and the earlier anticipatory bail application filed by the petitioners in Crl.O.P(MD)No.22452 of 2023 was dismissed by this Court on 13.12.2023. Now, this application is filed by the petitioners without referring the change of circumstances to consider the case. 5.Considering the above facts and circumstances of the case and also 2/3
considering the fact that there is no change in circumstances, since the dismissal of the earlier petition, this Court is not inclined to grant anticipatory bail to the petitioners.
