Petitioner PRAYER : Transfer Civil Miscellaneous Petition is filed under Section 24 of Code of Civil Procedure, to withdraw the proceedings in H.M.O.P.No.1407 of 2021 on the file of Sub Judge, Alandur, Kanchipuram District and to transfer the same to the file of Sub Court, Mudukulathur, Ramanathapuram District.

ORDER

The present transfer civil miscellaneous petition has been filed to transfer H.M.O.P.No.1407 of 2021 from the file of Sub Judge, Alandur, 1/4

Kanchipuram District to the file of Sub Court, Mudukulathur, Ramanathapuram District.

2. The notice taken on the respondent through Court and private notice taken on the learned counsel, who represents the interest of the respondent before Sub Court, Alanthur in H.M.O.P.No.1407 of 2021 has been returned.

3. The petitioner is a resident of Mudukulathur Taluk, Ramanathapuram District. The respondent, who instituted the aforesaid proceedings before the Sub Court, Alanthur, Kanchipuram District is a resident of Perungudi, Kanchipuram District.

4. Considering the fact that the petitioner is from Mudukulathur and the distance between the Mudukulathur and Kanchipuram is approximately 500 kilometres and considering the fact that the petitioner has a small child in her custody, the prayer of the petitioner deserves to be acceded. H.M.O.P.No.1407 of 2021 is directed to be transferred from Sub Judge, Alandur, Kanchipuram District to the Sub Court, Mudukulathur, Ramanathapuram District.

5. The transfer civil miscellaneous petition stands allowed with the above observations. No costs. consequently, connected miscellaneous petition is closed.
