JUDGMENT

The learned counsel for the sole appellant and the learned counsel for respondent Nos.1 to 3 are present before this Court.

2. The learned counsel for the sole appellant submitted that the sole appellant, namely Nallasiva Konar, has passed away and that no instructions have been received from the appellant's side and the main Second Appeal is abated due to the death of appellant. A memo to this effect has also been filed.

3. Recording the said memo, this Second Appeal is dismissed as abated. No costs. Consequently, the connected Miscellaneous Petitions are closed.
