ORDER : The Court Made the following order :- The petitioner, who is arrayed as A.1, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 498(A) and 506(ii) I.P.C. in Crime No.9 of 2015, on the file of the respondent police and hence, seeks anticipatory bail.
2. The case of the prosecution is that the accused have demanded more dowry and also harassed the defacto complainant.
3. The learned Counsel for the petitioner submitted that the accused 2 and 3 were granted anticipatory bail by the Sessions Court in Cr.M.P.No.1337 of 2015 on 06.06.2015 and due to the marriage had completely broken down, he petitioner has filed H.M.O.P.No.22 of 2015 before the Family Court, Dindigul for divorce and after receipt of the summon, this complaint is given.
4. The learned Counsel for the petitioner further submitted that the defacto complainant had deserted her matrimonial home one year prior to this complaint. It is further submitted that the petitioner is working as an Assistant Executive Engineer in Public Works Department.
5. Heard the learned Government Advocate(Crl.Side).
6. Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions.
7.Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Ottanchathiram and on his executing a bond for a sum of https://hcservices.ecourts.gov.in/hcservices/
Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police on two Saturdays and Sundays I.e. on 20.06.2015, 21.06.2015 and 27.06.2015, 28.06.2015 at 10.00 a.m. and thereafter as and when required for interrogation. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C.
